What the 2023 NEC Changed About EV Charger Installs in Washington Homes

Most homeowners have no reason to care which edition of the National Electrical Code their state is on. Then they get a quote for an EV charger, and suddenly the code edition is the difference between a $1,200 job and a $5,500 one.

Washington inspects electrical work to the 2023 NEC. Three of the changes in that edition deal directly with EV charging, and one of them is the reason a lot of Kent houses that would have needed a service upgrade under the old rules no longer do. That is worth understanding before you accept anybody’s quote.

Two housekeeping notes. What follows is a plain-language summary written for homeowners, not a substitute for the code text, and the NEC itself governs. And code changes, so check the date on this page.

Where Washington sits right now

Washington adopts the NEC through Chapter 296-46B WAC, administered by the Department of Labor and Industries, and L&I reviews those rules every three years to stay current with national standards.

The practical detail worth knowing: the 2026 NEC exists, but Washington is not on it yet. According to L&I’s electrical laws and rules page, the 2026 edition is scheduled to replace the current 2023 edition on December 31, 2026, with the rulemaking still working through hearings and comment periods before then.

So if you are installing a charger in Kent today, the 2023 NEC is the code your inspector is holding you to. If your project runs into January, ask your contractor whether anything relevant shifts. Ours will tell you without being asked.

Change 1: A defined way to calculate EV load (220.57)

The 2023 edition added Section 220.57, which gives a specific method for handling EVSE in a dwelling load calculation. Before this, EV chargers got folded into general load calculation rules that were never written with them in mind, and the result varied by whoever was doing the math.

Why this matters to you: load calculations decide whether your existing service is adequate. When the method was fuzzy, two contractors could look at the same Kent house and reach opposite conclusions, and the homeowner had no way to tell which one was right. A defined section means the calculation is now an argument about numbers rather than an argument about interpretation.

It also means you can ask for it. If a contractor tells you that you need a 200 amp service, ask to see the load calculation. A real one is a page of arithmetic with your square footage, your heating type and your appliance nameplates in it. If what comes back is “your panel is old,” that is not a load calculation.

Change 2: Load management became a legitimate alternative to a service upgrade (625.42)

This is the big one, and it is the change that saves Kent homeowners the most money.

EV charging is still treated as a continuous load, meaning the circuit gets sized at 125 percent of the charger’s rating. A 48 amp charger still wants a 60 amp circuit. That has not changed.

What changed is what happens when the house cannot spare that much capacity. The 2023 edition revised 625.42 so the load counted against your service can be limited by controls rather than by the equipment’s maximum rating. Section 625.42(A) covers installations managed by an energy management system, where the maximum load counted is the maximum the system permits. Section 625.42(B) covers fixed-in-place equipment with adjustable settings, where the adjusted rating can be used if the adjustment is made per the manufacturer’s instructions and the equipment is labeled to show it.

In a Kent East Hill split level with a 100 amp service, an electric range and a heat pump, this is often the difference between “you need a service upgrade first” and “we can do this next week.” A load management device that pauses or throttles charging when the rest of the house draws hard costs a few hundred dollars. A 200 amp service upgrade costs thousands. We broke both scenarios out with numbers in our itemized EV charger cost post.

I will give the honest caveat here that I give at estimates. Load management is not automatically the right answer. If you are planning a second EV, an induction range or an ADU in the next few years, paying once for a 200 amp service beats solving the same problem twice. And these systems only work if they actually shed load correctly, which is worth testing rather than assuming. The code permits the approach. It does not promise that every product does it well.

Change 3: One branch circuit can now serve more than one charger (625.40)

Under the 2020 edition, every EVSE outlet required its own individual branch circuit, full stop. The 2023 edition narrowed that requirement to outlets over 16 amperes or 120 volts, and added an exception permitting a branch circuit to feed multiple EVSE where 625.42(A) or (B) applies.

For a two car household, this is the code basis for power sharing. Two chargers on one managed circuit, each throttling so the pair never exceeds what the circuit can carry. Both cars charge slower when both are plugged in, which for people who charge overnight is a non-issue.

Before 2023 the answer to “can I add a second charger” was frequently a second circuit or a bigger service. Now it is often neither.

Change 4: The code caught up with bidirectional charging (625.48)

The 2023 edition expanded 625.48 to recognize wireless power transfer equipment alongside the charging technologies that already had power export provisions.

This matters mostly for people looking at vehicle-to-home setups, where the car becomes a backup power source during an outage. It is still a small category in Kent, though the questions have picked up noticeably since the last serious windstorm. If you are considering it, understand that a bidirectional install is a different scope of work from a standard Level 2 charger, involves interconnection considerations with Puget Sound Energy, and is not something to bolt onto an existing job as an afterthought.

What did not change, and still trips people up

GFCI protection for receptacle-connected chargers. The requirement for GFCI protection where a receptacle supplies EV charging came in with the 2020 edition and carries forward. This is one practical argument for hardwiring: with a cord-and-plug unit you can end up with protection at the breaker and protection inside the charger, and stacked protection is a well known source of nuisance tripping. It is not a code violation. It is just annoying, and it generates callbacks that are nobody’s fault.

Permits and inspections. Every new EV circuit in Kent needs a permit, and the contractor buys it, not you. The City of Kent does not run its own electrical inspection program, so it goes through L&I. We covered how that scheduling works in our post on install timelines.

Surge protection on service replacements. If your EV project turns into a panel replacement, current code requires surge protection on the dwelling service. Homeowners are sometimes surprised to see it on the quote and assume it is an upsell. It is a code requirement. More detail on what a panel job includes is on our electrical panel page.

The Washington-specific rule change that is actually in motion right now

Separate from the NEC cycle, L&I has rulemaking underway to implement Senate Bill 5528 from the 2025 session, which deals with EV supply equipment installation. A public hearing on the proposed rules is scheduled for late August 2026, and if adopted the amendments would take effect November 20, 2026.

Here is the part worth being clear about, because I have already seen it misrepresented. The certification requirement created by that legislation applies to EV chargers on public works projects. It does not apply to the charger in your garage. If somebody tells you that a new state law means only specially certified installers can touch a residential EV charger in Kent, that is not what the law says.

What has always applied, and still does, is that electrical work in Washington must be done by a licensed electrical contractor employing certified electricians, that the work must be permitted, and that it must be inspected. You can verify any contractor’s license yourself on the L&I contractor lookup, and I would rather you did.

One more Washington rule most homeowners do not know about

If you live in a condo, a townhouse or a planned development, Washington law limits what your homeowners association can do about EV charging. An association generally cannot prohibit you from installing a charger in your own personal, noncommercial parking space. It can place reasonable restrictions on chargers located in common areas or connected to a shared power supply.

In practice this means the association can tell you how the installation has to look and who is responsible for it. It cannot simply tell you no. Plenty of Kent townhouse owners have been told otherwise by a board that had not read the statute.

What this means when you get a quote

Four questions worth asking any Kent contractor, all of which come straight out of the above:

Ask to see the load calculation, not a verbal opinion about your panel. Ask whether load management under 625.42 was considered before a service upgrade was quoted, and if it was ruled out, why. Ask whether the quote is hardwired or receptacle-connected, and what that means for GFCI. And ask who is buying the permit, because the answer should always be the contractor.

A contractor who cannot answer these is either not thinking about your specific house or is hoping you will not ask. Neither is a good sign.
